1. Introduction

EduOpen is a federated project of Italian Universities and a set of selected partners.
The list of federated Universities is accessible from the Home Page of the website www.learn.eduopen.org and can be modified without prior notice.

The following Terms and Conditions of Use ("Terms") and the Policies for the Use of Data and Cookies ("Privacy Policies") apply to the use of the training delivery portal (learn.eduopen.org, "Learn") in all their functions.

Please read these Terms very carefully as these Terms govern how you access and use the content and activities of EduOpen.

By accessing and registering with EduOpen (Site and Learn) you agree that you have read, understood and agree to these Terms and Privacy Policies. Furthermore, you agree to receive the Newsletter sent for informational purposes only regarding the EduOpen service, without commercial purposes.

In case of non-acceptance of the Terms and Privacy Policies you must immediately stop using the EduOpen Learn portal resources.In these terms, "we", "our" refer to EduOpen.


2. Relationship between users and Universities


For any reason the use of EduOpen resources, including enrollment in courses or pathways and any certificates and attestations of attendance and completion of courses imply enrolment in a university or the issuance of University Credits or university degrees. The participating Universities, with their own regulations, may autonomously and subject to their own procedures and methods, attribute a formal value to the training activities completed on EduOpen.


3. Code of Honor


By registering and accessing the EduOpen portals you agree to follow a Code of Honor both with respect to the contents and materials and with respect to the identity and data provided.

By accessing the EduOpen portal and the courses provided in it I am informed that:

  • EduOpen was born as a product of the scientific reflection of the Italian Academy on Technology Enhanced Learning;
  • EduOpen shares the principles of Open Education;
  • EduOpen provides advanced training courses to generate deep and effective learning in a lifelong perspective;
  • EduOpen LMS is the content management system based on a modified and integrated Moodle release for Mooc delivery;
  • EduOpen takes care of efficiency, continuity and good quality of service reducing technical inconvenience;
  • EduOpen protects the privacy and confidentiality of user data whose use anonymously is justified only for statistical purposes, research or communication of course and portal updates;
  • the teaching materials on the portal have been licensed by teachers and universities with Creative Commons licenses, non-commercial attribution, 4.0 International, www.creativecommons.it;;
  • in each course the teachers have planned a training project aimed at achieving specific learning goals for which they use, present, motivate content, teaching methods, summative and formative evaluation methods.

  • Therefore I agree to

  • register with only one account and provide my personal data correctly and truthfully;
  • attending courses responsibly and profitably, consulting educational materials, actively participating in the educational dialogue, respecting deliveries;
  • use the didactic materials with caution, respecting the attributions of the Creative Commons licenses;
  • collaborate with teachers and course colleagues to achieve the educational objectives and to share the information and knowledge learned;
  • use the platform correctly without forcing/manometering/damaging the computer system on which it rests;
  • carry out the activities aimed at evaluation in person and without delegation;
  • respect colleagues and teachers in their interventions and language, maintaining courtesy and decorum and avoiding all forms of vulgarity and controversy including the promotion of illegal actions or actions aimed at violence, harassment, spam;
  • perfect the payment of fees for any participation in the evaluation tests aimed at obtaining certifications and training credits according to the rules and indications that will be given to me.



  • 4. Use of EduOpen resources


    1. By using EduOpen's resources (Site and Learn) and courses published therein (both as a Visitor and as a Registered User), you declare that you accept these Terms and Privacy Policies and all local, national and international laws and regulations.
    2. Your use of and access to the Site and Learn is subject to the following conditions and you acknowledge that any misuse of these Terms implies a breach of these Terms for which you assume full responsibility and may be prosecuted under the law:
      1. You agree not to use or post content that may be defamatory, offensive, harassing or threatening to others;
      2. You agree not to use content that discusses illegal activities with the intent to commit such activities or encourage others to commit illegal activities;
      3. You agree not to use content that does not respect the intellectual property of others including, but not limited to, copyright, trademark rights or trade secrets; ets;
      4. You agree not to use content for which you do not have the right to use;
      5. You agree not to use material of an obscene and/or pornographic nature including language, images and videos or language or material that may offend or harm in any way other users of the site;
      6. You agree not to use the Site or Learn for advertising, promotional or other commercial solicitation purposes;
      7. You agree not to use any content that in any way violates applicable national or international laws and regulations;
      8. You agree not to use content that may monitor or control the vulnerability of any computer system or network;
      9. You agree not to use content that in any way circumvent or breach any security system;
      10. You agree not to use content that may cause damage to other users, servers or networks, for example: viruses, spamming, mail-bombing, etc. ...;
      11. You agree not to use content that in any way may install malware or adware or in any way use the Site and Learn to distribute malware or adware;
      12. You agree not to extract data and use data from the Site or Learn without the prior consent of EduOpen;
      13. You agree not to use the Site or Learn for any commercial purpose without the prior consent of EduOpen.



    5. Data requested and their use, purpose and legal basis


    1. When you access the Learn platform of EduOpen, some personal data are recorded and will be used exclusively for information and training purposes related to the institutional activities of EduOpen;
    2. The personal data recorded will be stored in the archives of the Centro Intererateneo Edunova on behalf of the EduOpen Network and will not be provided to third parties for any reason. The internal contact person in charge of answering the requests of the interested parties is Prof. Tommaso Minerva, Director of the Centro Interateneo Edunova;
    3. When registering EduOpen requires the following personal data: Name, Surname, e-email address, institution, location, nationality. As part of your profile you can, voluntarily, integrate the requested personal data with other personal and contact details;
    4. Your browsing and use of the Site and Learn, including forum interactions, tasks and other materials, are also recorded;
    5. The data collected may be used for the following purposes:
      1. anonymously for analysis, study, publication and research purposes including your content;
      2. to provide the service and improve its quality;
      3. to protect us and our users;
      4. to provide you with the best possible user experience;
      5. to complete every act provided by the site (e.g. automatic completion of certificates, badges, etc...);
      6. to issue Open Badges through the partner CINECA (external data controller), transferring to them your name, surname and e-mail address exclusively for the provision of Open Badges on the Bestr platform;
      7. to participate in the authentication federation IDEM-GARR;
      8. to send you updates, news, newsletters about EduOpen services, courses you are enrolled in and courses that may be of interest to you;
      9. to manage your user profile on EduOpen platforms;
      10. to give you access to reserved areas and services reserved for registered users;
      11. to comply with legal obligations and requirements of judicial and public security authorities.
    6. We also inform you that for security reasons the IP address, time and duration of each connection (Log file) may be recorded; this data will be made accessible only to persons expressly authorized and only when necessary.
    7. All personal data provided are therefore processed exclusively for purposes related to the institutional activity of EduOpen (information and training purposes), whose legal basis - depending on the case - consists in the performance of a task in the public interest (the "relevant public interest" is defined as the activity of education and training in school, professional, higher or university) in the execution of a contract to which the user is a party (eg. for the provision of courses or to send information related to training services by e-mail and/or any other means of communication) or pre-contractual measures taken at the user's request or in the performance of legal obligations to which the Owner is bound.



    6. Nature of the data and consequences of any refusal to reply


    The provision of personal data in the various sections of the public portal ("Site") or in the portal for the provision of training activities ("Learn"), where expressly indicated as mandatory, is necessary for the use of the services requested. The refusal to provide the data necessary for these purposes may make it impossible to perform the service requested or to provide the other services available.

    Depending on the case and, if necessary, from time to time the user will be duly informed of the mandatory or optional nature of the provision of personal data. Failure to provide optional personal data, on the other hand, will not entail any obligation or disadvantage for our users.


    7. Transfer of data outside the EU


    The personal data provided by the user will not be transferred abroad to countries other than those belonging to the European Union, which do not ensure adequate levels of protection of persons. Should this be necessary to provide the services requested (for example, for certain processing activities that may be delegated externally to non-EU suppliers), we assure you that the transfer of personal data to countries that do not belong to the European Union and that do not ensure adequate levels of protection will be carried out only after the conclusion, between Centro Interateneo EDUNOVA and these parties, of specific contracts containing safeguard clauses and appropriate guarantees for the protection of personal data (e.g. standard contractual clauses approved by the European Commission) or only in the presence of another requirement that complies with applicable Italian and European legislation.


    8.Rights of the data subject


    The interested parties have the right at any time to obtain confirmation of the existence or not of personal data concerning them and their communication in an intelligible form.
    The interested parties have the right to obtain the indication:

  • the content and origin of the personal data;
  • the purposes and methods of processing;
  • the logic applied to the processing carried out with the aid of electronic instruments;
  • the identification details of the data controller and data processors;
  • the duration of storage in relation to the specific categories of data processed;
  • the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them, as data processors or persons in charge;

  • The data subjects also have the right to obtain::

  • the updating, rectification or, when they are interested, the integration of the data;
  • the cancellation, transformation into anonymous form or limitation of the data processed (e.g. if processed unlawfully), including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
  • request the immediate deletion of your data;
  • the portability of the data to another data controller;
  • the opposition to the processing (e.g. for sending advertising or direct marketing material or for carrying out market research or commercial communication);
  • the opposition to any automated decision-making process (including profiling);
  • the revocation of any consent given, where applicable (please note that the revocation of consent will not affect the lawfulness of the processing based on the consent given before the revocation);
  • certification that the operations referred to in the previous points have been brought to the attention, also as regards their content, to those to whom the data were communicated or disseminated, unless this requirement proves impossible or involves the use of means manifestly disproportionate to the protected right;

  • In order to exercise the above rights, the interested parties may write to the person in charge of data processing (privacy contact, Prof. Tommaso Minerva, Director of the Centro Intererateneo Edunova) by sending a communication to the following e-mail address [support@eduopen.it], indicating 'Privacy', or by writing to the contact details of the Data Protection Manager indicated below.

    Finally, you are reminded that you always have the right to lodge a complaint with the Data Protection Authority for the exercise of your rights or for any other matter relating to the processing of your personal data.


    9. Recipients of personal data


    For purely organizational and functional needs and for purposes strictly related and related to the provision of services, the personal data of users may be made available to third companies, contractually linked to the Owner, which provide specific services (eg. CINECA). These subjects, in their capacity as Data Processors, will process your personal data exclusively on behalf of the Owner and exclusively for the purposes indicated in this Privacy Policy and, in any case, in compliance with the limits of the law and any consents provided by you.

    Personal data will not be communicated, transferred or transferred to third parties for purposes not permitted by law or without express consent. In addition to the companies that act as data processors, the personal data are also made available to third parties (autonomous data controllers) who process the data autonomously solely for the performance of the services offered by EduOpen and for purposes ancillary and related to the provision of the services requested by the user..

    By way of example and not exhaustive, below are some of the third parties with whom we work closely and who could be the recipients of the user's personal data: providers of payment management services, providers of services or IT solutions in support of the EduOpen portals.user data will not be disseminated. This is without prejudice, in any case, to the communication or dissemination of data required, in accordance with the law, by police forces, judicial authorities, information and security bodies or other public entities for purposes of defence or state security or the prevention, detection or repression of crime.


    10. Period of data retention


    Users' personal data are processed for the time strictly necessary to achieve the purposes and purposes listed above. The data are stored without a time limit for as long as the user is registered on the platform.

    The criteria used to determine the storage period are established by:
    1. specific rules of law, which regulate the activity of EduOpen or the Universities;
    2. the period of retention of the interested party as a registered user of our services;



    11.Cookies and technologies for data analysis


    EduOpen platforms use Cookies to ensure access to systems and to identify the user and the devices with which they connect and to customize the user experience on the platform.

    EduOpen platforms use a proprietary access analysis tool. Data is not provided to any provider.


    12. License and Intellectual Property


    All content published on EduOpen ('Courses') is released under a Creative Commons Attribution, Share Alike, Non Commercial - International 4.0 license. Except for content produced by users, which is the exclusive property of the users themselves.

    In particular, it is allowed, in whole or in part, the use and modification of materials published by EduOpen as long as you attribute the work to the author by quoting:
    Name and Surname of the Author
    Institution Author
    Course Title
    Source URL
    Platform on which the course is published

    Use is subject to the fact that works containing materials published on EduOpen are released under the same type of license.

    It is not allowed the use, even partial, of contents and materials that foresee, in any type of form, commercial exploitation or possible revenue, even indirect.


    13. Right to modify the Terms and Conditions for the use of EduOpen


    EduOpen reserves the right to change and modify the Terms and Privacy Policies at its sole discretion and at any time without prior notice. Any change will take effect immediately upon publication on the EduOpen Website.

    EduOpen will make every effort, without any obligation, to communicate as best as possible any changes, it remains true that continuing to use EduOpen (Site and Learn) implies acceptance of the changes introduced.

    15. Processing of personal data


    In addition to what is stated in the document 'Terms and Conditions of Use of EduOpen and Privacy Policy' when using the EduOpen systems you accept the following additional conditions.

    The recorded data (personal data, evaluations, messages and tracking of activities) are stored and managed according to the regulations in force. The provider ensures the protection and confidentiality of your data within the limits and according to industry standard security procedures.

    The registered user is informed that the processing of his/her personal data is carried out for issues related to the provision of courses and the procedures of evaluation and certification of their completion.

    In accordance with Italian and European legislation on data protection (General Regulation on the Protection of Personal Data n. 679/2016), we inform that the data, collected through registration forms and profile pages on the platform, will be stored in databases, collected and processed for the following purposes:
  • scientific research activities closely related to the academic activity carried out by the scientific community of the network;
  • processing activities for statistical purposes of data concerning the way the portal is used and the learning methods of registered users;
  • communication and dissemination activities of events related to the portal (new online courses offered by EduOpen, maintenance or updates of the site);
  • preparation of annual reports;
  • administrative activities aimed at the management of the courses and the issue of certifications by EduOpen and third parties (member universities).


  • In relation to the processing of personal data carried out by the service provider, the user has the right to exercise the rights provided for by data protection legislation as specified in the Privacy Policy.

    Any changes to the policies of provision and use of the pages and courses of the EduOpen portal will be made known in this area and communicated promptly to users.
